Dui And The Nhtsa

The National Highway Traffic Safety Administration (NHTSA) is a federal organization, technically a part of the executive branch of the government under the Department of Transportation.

The National Highway Traffic Safety Administration created extensive data files of safety records which are maintained by the National Center for Statistics and Analysis. The most well known of these records is called the Fatality Analysis Reporting System (FARS) which is a resource for traffic safety research.

In the fight against drunk driving, or more commonly referred to as DUI, the NHTSA has worked closely with the organization Mothers Against Drunk Driving (MADD) on all aspects of traffic safety concerning alcohol. One of their most famous collaborations is the definition of the term, “alcohol related fatalities” to include any measurable amount of alcohol in a victims system to determine the incident as an “alcohol related fatality” regardless of fault.

What this means now is that a pedestrian could be walking down the sidewalk and a car with a sober driver could plow onto the sidewalk killing the innocent pedestrian and that would be considered an alcohol related fatality if the innocent pedestrian had any measurable amount of alcohol in their system. This and other similar instances inflate the FARS statistics.

What this now means is the records that are being kept and reported to the public are less than accurate. These inflated statistics are what is being used to justify ever stringent laws, lower blood alcohol levels, and harsher punishments for DUI offenders. This is being done due to the power of a very strong lobbying organization and political force named MADD.
