The Never Ending Battle Between Pedestrians And Vehicles
Posted on February 16, 2008 - Filed Under Legal and Law
In the recent analogy that I have made regarding the safety of the pedestrians, especially children, on the streets of Los Angeles, I can conclude that it is indeed hazardous for people to roam around the city particularly at night. This is very much evident on the huge number of vehicle drivers who defies the traffic rules and ignores the road signs. I even witness an accident wherein a motorcycle crashes to the sidewalk injuring the driver and two more pedestrians. This would also mean that the latest statistics, which shows that more than 25 road accidents happens everyday in California alone, is factual.
Across the United States, an average of 60,000 pedestrians dies due to road accidents each year. This number is increasing yearly for some unknown reasons. Hence, most of these casualties are brought about by drivers who fail to maintain discipline or neglect their duties of ensuring the safety of the people; may it be themselves, their passengers, or even the pedestrians. These occur regardless of the numerous laws that penalize abusive drivers on the roads.
Furthermore, the injuries suffered from vehicle-pedestrian accidents are very much devastating to those victims and their families. We just have imagine the size and strength of a car striking a person; what happens next is very much predictable…serious injuries or fatality. Usually, the injuries that pedestrians incur in tragic vehicular mishaps include head injuries, bone fractures, spinal cord damages and brain injuries, which results into a more severe cases of unconsciousness, seizures and comatose.
Meanwhile, the injured pedestrians and their families are entitled by the law to acquire such amount of compensation to cover the cost of their medical treatment and rehabilitation bills, pain and sufferings, lost wages, damages in property and other expenses that resulted to the accidents. They can acquire these damages only if they were able to file their claims to the liable party’s insurance company immediately after the accident occurs. Any delays in filing may weaken the claim since the statutes of limitation applies in this case.
In addition, the prevailing laws allow the victims to employ the aid of their trusted pedestrian accident attorney in pursuing a claim suit against the responsible party. Generally, the victims do not have any legal background that makes it difficult for them to file the case alone. This explains the necessity of a legal defender to help them obtain justice and recover the largest amount of damages possible.
To sum it up, pedestrians like us cannot avoid walking on the streets. We just have to be aware of the potential road scenarios and be more cautious while on the streets. Doing these steps would at least lessen the chances of being engaged in a fatal vehicle disaster. Safety still depends upon us.
