Copyright - Google Gets Slapped For Copyright Theft

Well, many of us have heard of the term “Google Slap.” That is when Google is the slapper. But now Google is the one that has been slapped.
Google, the Californian company that runs the world’s most popular search engine, lost a court case in Brussels Belgium on 13 February 2007 where it was found that Google had breached copyright.
Copiepresse, a copyright protection specialist, was representing a group of 18 mostly French language newspapers who complained that Google was using “cached” links to offer free access to archived articles from the papers that were sold on a subscription basis.

The Indian law of copyrigts is enshrined in the Copyright Act, 1957. The Act seeks to provide for the registration of copyrights in India. The object of copyright law is to encourage authors, artists and composers to create original works by rewarding them with exclusive right for a fixed period to reproduce the works for commercial exploitation.
What is Copyright
COPYRIGHT is a right given by the law to creators of literary, dramatic, musical and artistic works and producers of cinematograph films and sound recordings. In fact, it is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work.

The UK Patent Office conducted a consultation on one of the tests for patentability – which is whether an invention has an ‘Inventive Step’. The test is whether the invention is obvious to a person skilled in the art taking into account what prior art was available at the time when the patent application was filed.
The consultation looked at the wider significance of the ‘Inventive Step’ and whether there was any need for change. It also considered the possibilities of refining the ‘Inventive Step’ test under UK and European law.

Recently a friend of mine suffered from a severe bout of illness. A reputed medical practitioner made a mistake in diagnosing her illness and she was given the wrong medication. Although the hospital offered to pay for all her medical expenses and treatment free of cost her family refused. My friend and her family are planning to sue the doctor and the hospital for personal injury caused due to this medical malpractice. Most sites on the web are at least faintly familiar with the implementation of legal regulations related to their sites. Most, however, have never heard of the California Catch-22.
Most sites tend to view complying with legal regulations as a somewhat amorphous subject. You know you are supposed to do something, but are not particularly sure why or what to do. This leads to the rather humorous situation where many sites have terms and conditions that are completely inapplicable the what they are doing and also look startlingly similar to terms and conditions found on other sites. One might even imagine a bit of “cut and paste” was going on, but who am I to say!
