As we all knew that internet piracy had grow enormously from the past few years, this trend had to be stopped and people have to be aware that pirating online or downloading pirated files online is an offence. We as a member of a law abiding society understand the concept that we cannot steal people’s property. Most of us would not steal, intend to steal and will generally be honest and not appropriating things that do not belong to us; when we need something, we buy. However, most of us seem unable to apply this ideology when we get connected online. We download without paying, utilizing software without purchasing, and generally think that we will not get caught by doing so. The lack of public awareness in internet piracy was one of the crucial elements which stimulate such act. By contrasting the degree of public awareness with the growth of online piracy, we can tell that there are still a lot to catch up in order to control and to eliminate it.

The Internet, or simply “the Net”, has a profound impact on modern society by publicly providing a worldwide source of information, by being a preferred means of communication and by acting as a powerful entertainment tool. However, in the last few years, governments from all over the world are seeing it as a liability and are discussing how to take action to insure that it is not exploited by “cybercriminals”. This article evaluates the abstract idea of governmental control over the Internet, by providing potent arguments for both sides of the debate, in an attempt to decide whether this is the right path for prohibiting cyberspace abuse.

Posted on April 3, 2008 - Filed Under Automotive, Home and Family, Legal and Law | Leave a Comment

Wondering if a trademark is important to you as a business owner? Let’s start with the basics. A trademark is a word, phrase, symbol, or logo that distinguishes and identifies the source of goods of one company or person from another. For example, the name Kraft is trademarked, as is Nike’s “swoosh” logo.

The list of what constitutes a trademark is long. A trademark can also be granted to unique packaging such as the shape of Coca-cola’s bottle, building designs, color, sound, and even fragrance. Service marks receive the same legal protection, but are used to distinguish services instead of products.

Internet Law In 2007

Posted on March 20, 2008 - Filed Under Home and Family, Legal and Law | Leave a Comment

As we start off the 2007 year, many in the web community probably have questions about what developments we can expect in web law in 2007. Well, the issues already appear to be coming together.

Internet Law in 2007

The beauty of the web is it is still a relatively new communication platform and is evolving on a daily basis. From a legal standpoint, this raises all kinds of issues and problems. The law prefers stability. It is also generally slow to react to new issues. Since the net is evolving on a daily basis, this puts the legal issues regarding it in some what of a time warp. Simply put, the law is a couple years behind on issues such as phishing, privacy and so on. Still, 2007 is cranking up to be an interesting year.

Copyright And The Internet

Posted on March 16, 2008 - Filed Under Home and Family, Legal and Law | Leave a Comment

If a piece of work or something someone/some people have created then they should own the rights to it and therefore it belongs to them. There is of course varying degrees in how many rights they reserve and different countries more than likely have their own interpretations, but on the web this becomes a bit more of a grey area, with no-one to stringently enforce the laws, that’s not to say that if you do violate them you wont be caught.

TV

Channels are great, but! Have you every looked at TV as if it was the very first visual Blog. Each channel is a separate Topic. Each show is placed there by some blogger trying to sell their hype. However, is it right?

Here is a great example (in my opinion). The Sci-Fi channel. Hmmmmm - Sci-Fi. Does that include Wrestling? NO. I have yet to see a ray gun or a space ship of any kind. And my biggest pet peeve here is Horror. Unless there are aliens or some mad scientific experiment gone awry I do not want to see on this channel. PERIOD.

As you may have heard, the FTC recently reached a significant settlement with an adware firm by the name of Zango. So, what are the lessons learned from the settlement?

The FTC and Zango Settlement Regarding Adware

According to FTC filings, Zango was a rather prolific adware firm. From 2002 to 2005, Zango distributed its adware product to the huge number of Internet users without their knowledge according to the FTC. The product was placed on the computers of individuals when they went to download free games, screensavers and such. On top of this, the FTC alleged that Zango and its affiliates placed the programs on computers in such a way that it was difficult to both find and remove them.

Why Site Owners Must Know California Internet Regulations

Posted on January 28, 2008 - Filed Under Home and Family, Legal and Law | Leave a Comment

Most sites on the web are at least faintly familiar with the implementation of legal regulations related to their sites. Most, however, have never heard of the California Catch-22.

Most sites tend to view complying with legal regulations as a somewhat amorphous subject. You know you are supposed to do something, but are not particularly sure why or what to do. This leads to the rather humorous situation where many sites have terms and conditions that are completely inapplicable the what they are doing and also look startlingly similar to terms and conditions found on other sites. One might even imagine a bit of “cut and paste” was going on, but who am I to say!

The Crtc & The Internet - Forbidden Domain

“Please indicate if your Web site contains any of the following (select all that apply): Al Waxman, Alanis Morrisette, Alan Thicke, Alex Trebeck, Anne of Green Gables, Anne Murray, back bacon, bears, beavers…”

It hasn’t come to that – yet. The CRTC firing off questionnaires to professional web designers, amateur enthusiasts, or awkward teenagers reminding us yet again that the world simply doesn’t understand them. Anyone possessing the time and the inclination can create a website and have it up and running within hours. As of July 9, 2002 there were 2,073,418,204 web sites listed on Google with “no way of knowing definitely.” With that amount of sheer numeric volume, it is nearly impossible for any organization to tackle the responsibility of regulating web site content.
